Advertising in EasyWare

Intro
EasyWare has in excess of 50,000 downloads, of which more than 4,000 are registered users (as at July 2006). In order to keep our freeware versions of EasyWare free, we are introducing advertising into the software. Besides, the above statistics, we are unable to give any reliable usage figures. As such, over the next few months (until November 2006) we will be selling the advertisement spaces for a token fee. At the end of this period, we would have enough visitor/user statistics to determine a proper and more realistic pricing structure.

How it works:
Any selected logo will be displayed on a continuous carousel with 11 other logos. Each logo will be displayed for 9 seconds at a time and the carousel will continue for more than 7 hours, every time the software is started. If any advertiser wants its logo to be displayed for more than 9 seconds, they may pay for more in increments of 9 seconds. Similarly, the advertiser may pay to be listed for more than one week.

Position:
The position of the advertiser's logo in the carousel is on a first come first served basis. No advertiser will be allowed to leapfrog the logos in front of its own, in the carousel. However as the tenure of one logo expires, the logos behind will take up its position in the carousel.

Sizes:
The advert accepts two sizes. Logos of any other sizes may be rejected.
Small logo (120 X 90 pixels, WxH)
Large logo (180 X 90 pixels, WxH)

Price (until November 2006)
Small logo: $10 per week
Large logo: $15 per week

As explained above, the advertiser may increase the number of weeks that the logo is displayed and/or the length of time that the logo is displayed on the carousel (in multiples of 9 seconds), by paying additional fees

**We are unable to give you a start time for your advertisement at the moment. Most adverts start within a day of the time that they are purchased. We will inform you of the start time as soon as possible after we receive your payment.

IMPORTANT: READ THIS POLICY TERMS CAREFULLY BEFORE PURCHASING ANY ADVERTISING.

Our advertising policy and is subject to and in line with UK national advertising guidelines.
 
EasyWare's acceptance of an advertisement/logo should in no way be construed as our endorsement of the product or service being advertised.

Any advertising/logo is accepted solely at our discretion and we are not obliged to explain to a rejected advertiser why their advert or logo has been rejected. That said, we would not under any circumstances entertain advertisements or logos that promote or are involved with the following:

* Racism and racist materials
* Illegal drugs and narcotics, including controlled substances and unapproved Drugs
* Guns, firearms, Ammunition, and weapons of various kinds
* Bulk e-mail Advertising
* Any materials regarded as illegal under UK Law and the laws of the advertiser's country.

Any advertiser found to be breaking any of the above conditions will have their advert terminated immediately and risks having no refunds for the unused advertising.

UK Consumer Protection (Distance Selling) Regulation 2000, UK Data Protection Act of 1998 and the Electronic Commerce (EC Directive) Regulations 2002.

In accordance with the UK Consumer Protection (Distance Selling) Regulation 2000, we are bound to ensure that the following information is conveyed to and acknowledged as read by all customers. Kindly tick the 'agree' button above to acknowledge that you have read and understood the information, below.

1) The price including taxes: For all VATable orders within the UK and the EU, a charge of 17.5% VAT will be levied.

2) Arrangements for payment: All goods must be paid for by credit card before the purchasers are given access to the downloadable files.

3) Refunds: Due to the nature of service being offered, once the advertise has purchased space on the carousel, he/she would have effectively taken up the slot that would have gone to some other adviser, As such we will not normally entertain claims for refunds. Under certain special circumstances, we may choose to make a refund to an advertiser. This may include situations where we were liable for the mistake made by the advertiser in the first place. However any such action will not represent a change in our no-refund policy. Also, we reserve the right to charge an administration fee in order to process a refund.

4) Miscellaneous: Advertisers are particularly advised that it is their responsibility to ensure that the logo URLs, images and sizes are correct. The images may be changed at any time, as long as the URL remains the same.

As directed by the Electronic Commerce (EC Directive) Regulations 2002, our online selling and advertising is subject to UK law as our trading organisation is established in the UK. In accordance with the UK Data Protection Act of 1998, we affirm that we do not reveal any information held on our customers to third party organisations. Our shopping cart employs the use of cookies to track the goods in our customers' shopping cart. Any data held on you is used for and only for the purposes of transaction and book keeping.
